Who we are and what these terms cover
Magigraphy is a service of Yoinet Proyectos en la Red SL (tax ID B86286705, Serrano 93 3ºE, 28006 Madrid, Spain; hola@magigraphy.com). Our full details are in the Legal notice.
These terms govern the use of Magigraphy and the purchase of its plans. By creating an account or logging in, you accept them. How we handle your data is explained in the Privacy policy.
Who can buy: (to be confirmed).
What Magigraphy is
Magigraphy turns a photo into a magigraph. You choose the area that moves, an artificial intelligence model generates a short video of that area, and the video is placed over your photo. Outside that area, what people see is your photo.
You can download the result (code for your website, MP4, WebM, GIF and WebP) or, with a subscription plan, publish it hosted by us.
Your account
- You log in with a link we email you or with your Google account. There is no password.
- Each account has a personal workspace. What you create belongs to that workspace and nobody from another workspace can see it in Magigraphy. What you publish is the exception: hosted magigraphs (the website code and the email GIF) can be seen by anyone who has the code or the address.
- You are responsible for what is done with your account. Keep access to your email safe, because it is the key to your account.
- On the Studio plan, a workspace holds up to 5 people, counting the owner and pending invitations. Members share work and credits. Only the owner pays, invites and removes members. An invitation expires after 7 days.
- If a Studio workspace moves to another plan, members other than the owner can no longer use it. If it returns to Studio, they get their access back.
Credits and attempts
You pay per result, not per attempt.
- Each magigraph uses 1 credit, which includes up to 4 attempts. From the 5th attempt on, each further group of up to 4 attempts uses another credit.
- An attempt made with "Start from this" counts like any other. "Retouch crop" on an attempt already generated does not count.
- Attempts that fail because of a technical error, ours or the model's, do not count. If, as a result, the magigraph no longer needs a credit that was charged, it is refunded automatically.
- Credits that expire first are used first: those of your plan's month, then those of the Pack and, last, those that never expire.
- Free trials have a daily spending limit shared by all Free plan users. When it is reached, the Free plan does not generate until there is room again, counted over the last 24 hours.
Plans and prices
- Free: €0. 2 magigraphs, once per email address, no card. Downloads at 1280 px with the "magigraphy" watermark, and the website code carries the "Made with Magigraphy" badge. Hosted publishing is not included.
- Pro: €19 a month or €190 a year. 15 magigraphs a month. Downloads up to 1920 px with no watermark. Hosted publishing for websites and emails with up to 100,000 views a month.
- Studio: €79 a month or €790 a year. 75 magigraphs a month, up to 5 people in one workspace and up to 1,000,000 views a month. Includes everything in Pro.
- Pack: €29 in a single payment. 10 magigraphs that expire after 12 months. Downloads up to 1920 px with no watermark. Hosted publishing is not included.
Prices include VAT. If you are a business in a European Union country other than Spain and have a valid VAT number, you pay the same amount without VAT, under the reverse charge.
Pro and Studio credits renew every month, counted from the day you subscribed, on yearly plans too. Credits not used in a month do not carry over. The 2 Free credits never expire.
Payment, renewal and cancellation
- Payments go through Stripe. We never see or store your card details. Stripe issues the invoices, which the workspace owner finds in "Account and plans", under "Manage subscription and invoices".
- Subscriptions renew automatically at the end of each period, monthly or yearly, until you cancel.
- The workspace owner can change plan or cancel at any time from that same link. Changes between plans are prorated.
- If you cancel, your plan runs until the end of the period you paid for. After that, the workspace moves to Free and you keep your work.
- If a subscription is not renewed, for example because a payment fails, the workspace also moves to Free.
Right of withdrawal
If you are a consumer, the law gives you 14 days to withdraw from a contract made at a distance. Because Magigraphy can be used straight away, before you pay we ask you to tick this box:
"I want to start using Magigraphy right away and I understand I lose my 14-day right of withdrawal once I use a credit."
You cannot pay without ticking it. We record the date, who ticked it and the version of the text.
Your photos and your results
What you upload and what you create with Magigraphy is yours. You give us permission to store, process and serve it only to provide the service: generating attempts, exporting, and hosting what you publish.
By uploading a photo, you guarantee that you hold the rights needed for it and, if recognisable people appear in it, their consent to use it this way. If not, you are answerable to whoever holds those rights.
We don't train models on your photos
We do not use your photos or your results to train artificial intelligence models. This is our own commitment.
To create a magigraph, your photo goes through artificial intelligence providers that have their own terms: fal, which runs the models; MiniMax, the maker of the video model; and Anthropic, which analyses the photo. According to fal's terms, what you upload stays yours, but fal may use anonymised data derived from it for its models, and MiniMax's terms also apply.
Prohibited content
You may not use Magigraphy to:
- upload photos you have no rights to, or of recognisable people without their consent;
- create or share sexual content involving minors;
- create or share intimate or sexual images of a person without their consent, including manipulated ones;
- pass off something false about a person as real, to deceive or harm;
- create content that is illegal, harasses, or incites hatred or violence;
- infringe intellectual or industrial property, image or privacy rights;
- abuse the service: get around its limits, automate it without permission, attack it, or create several accounts to get more free magigraphs.
If you break these rules, we may remove the content, stop serving what you have published, and suspend or close your account.
If you see something hosted by Magigraphy that you believe is illegal or against these terms, email us at hola@magigraphy.com with the link and the reason.
AI-generated content
The motion in a magigraph is generated by an artificial intelligence model. If you publish one that could pass for real, it is up to you to say that it was generated or manipulated with artificial intelligence when the law requires it.
What you publish with us
With Pro or Studio you can publish a magigraph hosted by us. You get a code for your website and an image for your emails, paste them once, and from Magigraphy you can change the attempt that shows or pause it without touching them again.
- Views. We count a view each time a website loads the code, and an open each time the email GIF loads. Robots we know of are not counted. Gmail and other email services cache images, so opens are approximate.
- View limit. Pro includes up to 100,000 views a month and Studio up to 1,000,000, adding up web and email across the whole workspace, per calendar month in UTC. When the limit is reached, what you published stops moving until the next month or until you upgrade, and we email the workspace owner.
- If you pause, reach the limit or cancel, the website shows the still photo and the email shows the still image of the first frame. Nothing breaks on your site. If you subscribe again, everything moves again.
- While the publication exists, we keep serving the photo.
What you have downloaded is yours and does not depend on your plan.
Availability of the service
We work to keep Magigraphy running at all times, but there may be interruptions for maintenance, failures or causes beyond our control. We may change, improve or withdraw features.
Leaving
You can stop using Magigraphy whenever you want. To close your account or ask us to delete your data, email us at hola@magigraphy.com from your account's email address.
Transfer of the contract
Yoinet may transfer this contract, together with the data needed to keep providing the service, to whoever acquires Magigraphy or the business it belongs to. We will let you know.
Changes to these terms
If we change these terms, we will publish the new version here with its date.
Governing law and courts
These terms are governed by Spanish law. Any dispute falls to the courts of (to be confirmed), unless you are a consumer, in which case the courts of your place of residence are competent.
